We offer quantum expertise in relation to the application of our extensive quantity surveying, monitoring and surety experience.
We carry out extensive and thorough forensic analysis of quantum issues which can be provided in written reports suitable as evidence as an expert witness in court or before arbitral tribunals or for use in other forms of dispute resolution, such as adjudication or mediation.
We have considerable experience in working with solicitors and their clients and all reports are prepared in accordance with CPR and RICS guidelines. Our team has courtroom experience and are Fellows or Members of the Royal Institution of Chartered Surveyors.
Each of the Senior Partners has acted in the role of Expert Witness and as a RICS Expert Witness. All have dealt with construction quantum issues and the specific service areas in which they are individually highly experienced. Paul Rigby in particular has authored many Expert’s Reports and given evidence to tribunals on several occasions. The Partners have accepted instructions from both claimants and defendants. All Expert’s Reports are prepared in accordance with CPR Part 35 – Experts and Assessors, as well as the RICS Practice Statement – Surveyors Acting as Expert Witnesses.
What is an Expert Witness?
An expert witness, sometimes referred to as a professional witness is regarded as a qualified expert, who, by virtue of education, training, skill or experience can provide accurate and specialised knowledge in a particular subject. In the legal system expert witnesses are often used to provide expert opinions on circumstances, evidence, facts or experiences to assist in legal cases and investigations. It is common practise that expert witnesses will provide evidence in court about facts from their domain of expertise. Expert witnesses may also deliver expert evidence about facts from the domain of their expertise. At times, their testimony may be rebutted with a learned treatise, sometimes to the detriment of their reputations.
What is a RICS Expert Witness?
The Royal Institution of Chartered Surveyors (RICS) is a professional body that accredits professionals within the land, property and construction sectors. Members holding RICS qualifications, including a RICS Expert Witness may use the following designations after their name: MRICS (Member), FRICS (Fellow), AssocRICS (Associate). A RICS expert witness, is a professional witness qualified as a surveyor, chartered quantity surveyor, or someone qualified in an area of the built environment. A RICS expert witness will be able to provide accurate and specialised knowledge in relation to building standards and regulations.
